The EUs Minimum Wage Directive has been challenged before the CJEU, and AG Emiliou proposes to nullify the directive. The blog questions the legal quality of his opinion. Moreover it criticises how the EU increasingly creates employment law directives which do not create rights, but instead only rely on procedural obligations for Member States modelled on new governance procedures
